Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Zensory platform (“Service”) operated by The Zensory (“we”, “us”, or “our”). By signing in to the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Service.

Zensory is a personalised mindfulness and sensory wellness platform that provides chronotype assessments, sensory preference profiling (Z-SEM), and tailored mindfulness recommendations. Access to the Service is provided to employees and authorised users of organisations that have entered into a separate agreement with us (“Organisation”).

The Service is provided for informational and wellbeing purposes only. It does not constitute medical advice, diagnosis, or treatment. Always seek the guidance of a qualified health professional for any health concerns.

The Service is intended for use by employees and authorised personnel of subscribing Organisations. Access is granted through your Organisation's Microsoft Azure Active Directory account. You must:

• Be at least 18 years of age
• Be an authorised user of your Organisation's Azure AD tenant
• Use the Service only for lawful, personal wellbeing purposes
• Not share your account credentials or allow others to access the Service using your identity

Your Organisation is responsible for managing access. If your employment or relationship with your Organisation ends, your access to the Service may be terminated.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorised access to any part of the Service, its servers, or connected systems
• Reverse engineer, decompile, or disassemble any portion of the Service
• Transmit any malicious code, viruses, or disruptive material
• Scrape, harvest, or collect data from the Service by automated means
• Impersonate any person or entity or misrepresent your affiliation
• Use the Service in a manner that could damage, disable, or impair its performance

We reserve the right to suspend or terminate access for any user who violates these provisions without notice.

All content, features, functionality, design, text, graphics, assessments, scoring methodologies, and software comprising the Service are owned by The Zensory or its licensors and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your personal wellbeing purposes in accordance with these Terms. No other rights are granted.

You retain ownership of any personal data you submit. By submitting questionnaire responses, you grant us a licence to process that data as described in our Privacy Policy.

The assessments, scores, and recommendations provided by the Service are for general informational and wellbeing purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.

Zensory makes no warranties that the Service is appropriate for individuals with specific health conditions. If you have concerns about your physical or mental health, please consult a qualified healthcare professional before acting on any information provided by the Service.

To the fullest extent permitted by law, The Zensory, its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — including but not limited to loss of data, loss of profits, or loss of goodwill.

Our total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the greater of (a) the amount paid by your Organisation for access to the Service in the twelve months preceding the claim, or (b) £100.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

You agree to defend, indemnify, and hold harmless The Zensory and its officers, directors, and employees from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Service.

We strive to maintain continuous availability of the Service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised “Last updated” date. Continued use of the Service after such changes constitutes acceptance of the revised Terms.

We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms or if your Organisation's subscription ends. Upon termination, your right to use the Service ceases immediately.

You may request deletion of your account and data at any time by contacting us at privacy@thezensory.com. See our Privacy Policy for details on data retention.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
